EULA - End User License Agreement

LICENSE AGREEMENT
Sinaps Comfort

This user license agreement (the "AGREEMENT") is an agreement between you (individual or single entity) and the authors - Dmitri Tregubov and Sinaps Group (the "Sinaps Group"), for the Sinaps Group software product "Sinaps Comfort" (the "SOFTWARE") that is accompanying this AGREEMENT.

By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this AGREEMENT.
If you do not agree to the terms of this AGREEMENT, you must remove SOFTWARE files from your storage devices and cease to use the product.

The SOFTWARE is the property of Sinaps Group and is protected by copyright laws and international copyright treaties.
The SOFTWARE is not sold, it is licensed.

1. GRANT OF LICENSE

This is not free SOFTWARE.
The SOFTWARE is distributed as "try before you bay", however payment is required for continued use of the product.

1.1 Unregistered copy (the "TRIAL VERSION")
Anyone may use this SOFTWARE for evaluation purposes during a test period of 30 days.
Following this test period of 30 days or less, if you wish to continue to use SOFTWARE, you MUST make a registration payment.

1.2 Distribution of TRIAL VERSION
The TRIAL VERSION, may be freely distributed, with exceptions noted below, provided the distribution package is not modified. No person or company may charge a fee for the distribution of the SOFTWARE without written permission from the copyright holder. The TRIAL VERSION may not be bundled or distributed with any other package without written permission of the copyright holder.

1.3 Registered copy
After you have purchased the license for SOFTWARE, and have received the license key enabling the registered copy, you are licensed to copy the SOFTWARE only into the memory of the number of computers corresponding to the number of licenses purchased. The primary user of the computer on which each licensed copy of the SOFTWARE is installed may make a second copy for his or her exclusive use on a portable computer.
Under no other circumstances may the SOFTWARE be operated at the same time on more than the number of computers for which you have paid a separate license fee.
You may not duplicate the SOFTWARE in whole or in part, except that you may make one copy of the SOFTWARE for backup or archival purposes.
You may terminate this license at any time by destroying the original and all copies of the SOFTWARE in whatever form.
You may permanently transfer all of your rights under this AGREEMENT provided you transfer all copies of the SOFTWARE (including copies of all prior versions if the SOFTWARE is an upgrade) and retain none, and the recipient agrees to the terms of this AGREEMENT.

2. RESTRICTIONS
You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the SOFTWARE, or any subset of the SOFTWARE, except as provided for in this AGREEMENT. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

3. TERMINATION
Without prejudice to any other rights, Sinaps Group may terminate this AGREEMENT if you fail to comply with the terms and conditions of this AGREEMENT. In such event, you must destroy all copies of the SOFTWARE.

4. COPYRIGHT
All copyrights to the SOFTWARE are exclusively owned by the authors - Dmitri Tregubov and Sinaps Group.

5. LIMITED WARRANTY
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE USER MUST ASSUME THE ENTIRE RISK OF USING THE SOFTWARE.

6. LIMITATION OF LIABILITY
IN NO EVENT SHALL THE AUTHORS OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF THE SOFTWARE, EVEN IF THE AUTHORS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY EVENT, ANY LIABILITY OF THE AUTHORS OR ITS SUPPLIERS WILL BE LIMITED TO REFUND THE PURCHASE PRICE.

7. MISCELLANEOUS
If you acquired the SOFTWARE in the US, this AGREEMENT is governed by the laws of the state of Texas. If you acquired the SOFTWARE outside of the US, then local laws may apply.

All rights not expressly granted here are reserved by Sinaps Group.
